  11.  
  12. 1.   The Schedule of a Party sets out the reservations taken by
  13. that Party, pursuant to Articles 1108(1) and 1206(2), with respect
  14. to existing, non-conforming measures that derogate from an
  15. obligation relating to:
  16.  
  17.      (a) national treatment, pursuant to Article 1102 (Investment)
  18.  or 1202 (Services);
  19.  
  20.      (b) most-favored-nation treatment, pursuant to Article 1103
  21.  (Investment) or 1203 (Services); 
  22.  
  23.      (c) local presence, pursuant to Article 1205 (Services);
  24.  
  25.      (d) performance requirements, pursuant to Article 1106
  26.  (Investment); or
  27.  
  28.      (e) nationality requirements for senior management or members
  29.  of boards of directors, pursuant to Article 1107
  30.  (Investment).

  32. 2.   Each reservation sets out the following elements (ftnt 1):
  33.  
  34.      (a) SECTOR refers to the general sector in which the
  35.  reservation is taken;
  36.  
  37.      (b) SUB-SECTOR refers to the specific sector in which the
  38.  reservation is taken;
  39.  
  40.      (c) INDUSTRY CLASSIFICATION refers to the activity, where
  41.  applicable, covered by the reservation according to
  42.  domestic industry classification codes;
  43.  
  44.      (d) TYPE OF RESERVATION specifies the obligation referred to
  45.  in paragraph 1 for which a reservation is taken;
  46.  
  47.      (e) LEVEL OF GOVERNMENT indicates the level of government
  48.  maintaining the measure for which the Party is taking the
  49.  reservation;
  50.  
  51.      (f) LEGAL CITATION identifies the specific existing measures,
  52.  where applicable, for which the reservation is taken;
  53.  (ftnt 2)
  54.  
  55.      (g) DESCRIPTION describes the non-conforming aspects of the
  56.  existing measures for which the reservation is taken and,
  57.  where applicable, commitments for liberalization upon
  58.  entry into force of this Agreement; and
  59.  
  60.      (h) DURATION sets out the period for which the reservation is
  61.  taken and the phase-in of commitments for liberalization.
  62.  
  63. 3.   In the interpretation of a reservation, all elements of the
  64. reservation should be considered.  Where the DURATION does not
  65. provide for liberalization, the LEGAL CITATION shall govern to the
  66. extent of any inconsistency with any other element.  Where the
  67. DURATION provides for liberalization upon or after entry into force
  68. of this Agreement, the DURATION shall govern to the extent of any
  69. inconsistency with any other element. 
  70.  
  71. 4.   Where a Party maintains a measure that requires that a service
  72. provider be a citizen, permanent resident or resident of its
  73. territory as a condition to the provision of a service in its
  74. territory, a reservation for Articles 1202, 1203 or 1205 taken with
  75. respect to that measure shall operate as a reservation for Articles
  76. 1102 or 1103 with respect to the effect of that measure on the
  77. ability of the service provider to establish an investment.
  78.  
  79. 5.   For purposes of this Annex:
  80.  
  81. CMAP means Clasificación Mexicana de Actividades y Productos;
  82.  
  83. concession means an authorization provided by the State to a person
  84. to exploit a natural resource or provide a service, for which
  85. Mexican nationals and Mexican enterprises are granted priority over
  86. foreigners; 
  87.  
  88. CPC means Central Product Classification numbers as set out in
  89. Statistical Office of the United Nations, Statistical Papers,
  90. Series M, No. 77,  Provisional Central Product Classification,
  91. 1991;
  92.  
  93. foreigners' exclusion clause means the express provision in an
  94. enterprise's by-laws, stating that the enterprise shall not allow
  95. foreigners, directly or indirectly, to become partners or
  96. shareholders of the enterprise;
  97.  
  98. international cargo means goods that have an origin or destination
  99. outside the territory of a Party;
  100.  
  101. Mexican enterprise means an enterprise constituted under the laws
  102. of Mexico;
  103.  
  104. Mexican national means a national of Mexico, as defined by the
  105. Constitution of Mexico;
  106.  
  107. person of a Party means a national or an enterprise of a Party; and
  108.  
  109. SIC means:
  110.  
  111.      (a) with respect to Canada, Standard Industrial
  112.  Classification (SIC) numbers as set out in Statistics
  113.  Canada, Standard Industrial Classification, fourth
  114.  edition, 1980; and
  115.  
  116.      (b) with respect to the United States, Standard Industrial
  117.  Classification (SIC) numbers as set out in the United
  118.  States Office of Management and Budget, Standard
  119.  Industrial Classification Manual, 1987.

  122. FOOTNOTE 1:  The reservations are current as of September 5, 1992. 
  123. The three delegations understand that where a Party adopts
  124. liberalizing measures prior to the date of entry into force of this
  125. Agreement, such measures will be considered to be existing
  126. measures.   
  127.  
  128. FOOTNOTE 2: The three delegations are considering the need for
  129. inclusion of language to the effect that measures set out in the
  130. LEGAL CITATION shall be deemed to include existing administrative
  131. decisions, interpretations and practices pursuant to the measure
  132. cited.
